The NFL wagering lull is upon us, but there\u2019s still news on the sports betting<\/strong> front in Pennsylvania<\/strong>.<\/p>\n High tax rates<\/strong> are crimping online casino<\/strong> expansion, but PA online sportsbooks<\/strong> remain a hot ticket.<\/p>\n Oh, and that pesky Wire Act<\/strong> is still kicking around.<\/p>\n Bethlehem-based Wind Creek<\/strong> is poised to enter the PA sports betting <\/strong>market after getting a conditional approval to partner with Betfred<\/strong>,<\/strong> a privately owned retail bookmaker with 1,600 locations in the United Kingdom.<\/p>\n Gamblers should appreciate the role of luck in the company\u2019s founding. Apparently, a\u00a0successful bet<\/strong> on England to win the 1966 World Cup <\/strong>helped staked the company.<\/p>\n The British company has partnered with SCCG Management<\/strong> in Las Vegas to represent them in US markets.<\/p>\n The Pennsylvania Gaming Control Board<\/strong> (PGCB) still needs a final sign-off, and\u00a0Wind Creek, which had operated as Sands Bethlehem<\/strong>, will also need to secure a sports betting license. After that, it could move to add a retail sportsbook<\/strong>, potentially an online one. Online casino and online poker may also be in the cards, though no concrete plans have been disclosed.<\/p>\n A Wind Creek sportsbook launch would mean 13 retail operators<\/strong> in the state. It could also become the ninth online sportsbook<\/strong> if that step follows.<\/p>\n The\u00a0tax rates\u00a0for\u00a0online gambling<\/strong>\u00a0are literally and figuratively all over the map in the US. PAOnlineCasino <\/em>did a deep and charted out the rates for online casinos and online sportsbook jurisdictions across the country.<\/p>\n Nine states<\/strong>, including PA<\/strong> and NJ<\/strong>, have\u00a0online sports betting<\/strong>. The lowest tax rates<\/strong> among the online sportsbook jurisdictions are Nevada and Iowa, with 6.75%<\/strong>.<\/p>\n The highest, Rhode Island<\/strong> and Delaware<\/strong>, use a \u201crevenue sharing\u201d model and include a cut for the state vendor. Their rates stand at 83%\u00a0<\/strong>and 62.5%<\/strong>, respectively.<\/p>\n PA\u2019s online sportsbook market has proven appealing to operators despite its hefty 36%<\/strong> tax rate on revenue. The growing popularity of sports betting, along with a large population<\/strong>, are major reasons PA\u2019s sports betting market continues to grow.<\/p>\n Just three states have online casinos \u2014 Delaware,\u00a0Pennsylvania<\/strong>, and\u00a0New Jersey<\/strong>\u00a0\u2014 with regulated online betting on\u00a0slots<\/strong>,\u00a0poker<\/strong>, and\u00a0table games<\/strong>.<\/p>\n Tax rates for online casino operations run from as low as 15%<\/strong> in New Jersey to 62.5%<\/strong> in Delaware. PA online casinos<\/strong> have varying tax rates depending on the vertical. PA\u2019s rates are 54%<\/strong> for online slots, but 16%<\/strong> for online poker and online table games.<\/p>\n The \u00a0position on its Wire Act case, which threw cold water on internet gambling is this:<\/p>\n The Office of Legislative Counsel <\/strong>(OLC) opinion from the Department of Justice<\/strong>, which sought to expand the scope of the Wire Act to cover all forms of gambling, was denied in June. But the case is far from over.<\/p>\n The DOJ appealed that New Hampshire District Court ruling and has now submitted an appeal brief to the\u00a0First Circuit<\/strong> court. Another brief from Sheldon Adelson<\/strong>-backed groups have chimed in as well as the process drags on.<\/p>\n The\u00a0New Hampshire Lottery<\/strong> has until Feb. 26<\/strong> to submit its brief in response.<\/p>\n No matter what the First Circuit<\/strong>\u00a0finds, there is a high likelihood that a\u00a0Supreme Court<\/strong> petition will follow.
